Terms and Conditions

These Terms and Conditions govern all sales of goods and services by Bingley Stone, a trading style of Bingley Roofing Contractors Ltd. (“we,” “us,” or “Bingley Stone”). By placing an order, you (“the Buyer”) agree to these terms. These apply to both business and consumer purchases in the UK. Separate terms may apply for international orders—contact us for details.

Definitions

  • Goods: All products and services sold by Bingley Stone, including replacements for defective items.

  • Contract: The agreement between you and Bingley Stone for the purchase of Goods.

  • Bingley Stone: A trading style of Bingley Roofing Contractors Ltd.

Orders and Acceptance

  • For all orders, we will provide an order confirmation detailing the specifications as we understand them, including CAD drawings where applicable.

  • You must review and sign the order confirmation to confirm there are no mistakes or omissions. The order will be produced strictly in accordance with the signed order confirmation.

  • We may refuse or cancel any order at our discretion without liability.

  • Orders, or any part of an order, cannot be cancelled once the Goods have been cut to order. Such Goods will be invoiced at full price, regardless of cancellation attempts.

  • For standard products, orders cannot be cancelled without our prior written consent. If approved, a restocking fee may apply.

Prices and Payment

  • Prices are those in effect at the time of dispatch and exclude VAT, which is charged at the current UK rate.

  • We accept bank payments and credit cards. Full payment is required before dispatch.

  • If legal action is needed to recover unpaid amounts, we may charge an administration fee.

  • Goods cut to order will be invoiced at full price, even if cancellation is attempted, as these are non-cancellable once production begins.

  • Restocking fees apply only to standard products, not to Goods cut to order.

Natural Stone Variations

  • Natural stone varies in colour, texture, veining, and thickness. Samples and website images are indicative only and not exact representations.

  • You are responsible for understanding and accepting these natural variations before ordering. We recommend reviewing samples and, where possible, visiting our site to inspect products.

  • We are not liable for claims arising from natural variations or the natural ageing of stone, as this is expected with natural products.

Delivery

  • Kerbside Delivery: Goods are delivered to the roadside at the address you provide. You are responsible for moving Goods from the delivery point to your desired location, including arranging any necessary labour.

  • We aim to meet estimated delivery times but are not liable for delays beyond our control, including any labour costs you incur due to delays.

  • We may deliver in instalments over a maximum of six months from the order date.

  • Notify us in writing within 3 days of receipt for shortages or damage in transit, or within 5 days of a statement for non-delivery. Claims may not be accepted otherwise.

  • You must ensure site access for delivery vehicles and have someone authorised to receive the Goods. We are not liable for costs (e.g., re-delivery or returns) if access is restricted or no one is available.

Returns

  • Returns are accepted only for Goods damaged in transit or with manufacturing errors (e.g., incorrect sizes). Natural stone variations or ageing are not valid reasons for returns.

  • You must notify us in writing within 3 days of receipt, including the purchase date and invoice number. Returns must be in original condition.

  • We do not accept returns for made-to-order Goods unless faulty. For standard stock items, we may approve returns with a restocking fee at our discretion.

  • You are responsible for return delivery costs and providing proof of delivery. No credit will be issued without proof.

  • If Goods are faulty, we may repair, replace, or refund at our discretion. This is your sole remedy.

Guarantees

  • We will repair or replace items with defects due to faulty workmanship, or design, provided they are returned as per our Returns policy.

  • No claims are accepted for natural stone variations, colour or natural ageing, as these are inherent to the product.

  • All other warranties or conditions (express or implied) are excluded to the fullest extent permitted by law.

Data Protection

  • We handle your personal data in line with our GDPR-compliant Privacy Policy, available on our website.

Dispute Resolution

  • If you have a concern, please contact us first to resolve it informally. Write to Bingley Stone, Cullingworth Mills, Cullingworth, West Yorkshire, BD13 5AB or email info@bingleystone.com.

  • If we cannot resolve the issue within 30 days, we may agree to mediation before pursuing legal action. All disputes are governed by English law and subject to the exclusive jurisdiction of the English Courts.

Liability

  • We are not liable for consequential or indirect losses (e.g., loss of profit) arising from the supply of Goods, except as expressly stated or where required by law (e.g., death or personal injury due to our negligence).

  • You are responsible for ensuring Goods meet your needs. We are not liable for errors in product descriptions or images unless caused by our negligence.

  • We do not specify performance or suitability requirements for your intended use of the Goods. You must seek professional advice from qualified architects or structural engineers for necessary calculations and compliance with regulatory requirements, as we are not qualified to undertake this on your behalf.

Force Majeure

  • We are not liable for delays or failure to perform due to events beyond our control (e.g., natural disasters, supply chain issues). If such events persist for 60 days or more, we may cancel the order without liability.

Ownership and Risk

  • Risk in the Goods passes to you when loaded onto delivery vehicles at our premises.

  • Title remains with us until full payment is received.

Promotions

  • We may send you promotional materials by post, email, or other means. Our standard terms apply to all promoted Goods and services.

Copyright

  • All content in our catalogue and website is copyrighted. Reproduction or transmission without our written consent is prohibited.
